Terms of Purchase & Warranty Statement

Definitions: As used in this sales order, “Order” shall mean this sales order and all attachments, exhibits and documents to which reference is made, “Material” shall mean the goods and services covered by the Order, “Seller” shall mean the person, corporation or other entity to whom the Order is addressed, and “Purchaser” shall mean the corporation in whose name this Order is issued.

Acceptance: The terms of a written acknowledgment or other document shall not be effective to amend, supplement or negate any of the terms of the Order but shall constitute acceptance of all the terms of the Order. If the Order is deemed to be the acceptance of Seller’s offer, such acceptance is expressly limited to the terms of the Order and the Purchaser specifically objects to any different or additional terms, whether material, contained in such offer.

Shipping:Thomas Parts uses a custom algorithm to automatically calculate freight based upon a few factors including dimensions, destination location, and others. All items will ship within (48) hours of both placing the order and completion of payment to include full funds received. Shipping times can vary depending on geographical location, carrier, and holiday schedules. To ensure efficient shipping times, some products may be shipped directly from the manufacture or otherwise. 

Product Return:Your satisfaction is our destination. All our products can be returned within (15) days of receipt of sales order purchase date for a full refund excluding shipping cost and additional installed equipment. The part must be returned in equal condition, uninstalled, in unaltered condition. All returns are subject to a (15% restocking fee). Part refunds are processed within 10-15 business days of receipt of proper paperwork via original payment form only with exception of Cash/Wire Transfer.

Core Returns:All cores to include engines, transmissions, differentials, electronic(s), or otherwise that are sold with an initial core charge are to be returned within (30) days of receipt of sales order purchase date. Failure to receive core(s) within (30) days will result in forfeiture of core amount. Customer is responsible for packing, and shipping materials for safe return of core(s)

Core Quality Guideline

Engines – Must Turn 360, Complete from Flywheel to Fan Clutch, No holes in the block, returned in equal condition to purchased product.

Warranty

Used Engines –Covered for a period of (90) days from receipt of sales order listed purchase date.

Rebuilt Engines Covered for a period of (1) Year or (365) days from receipt of sales order listed purchase date.

Transmissions & Differentials – Covered for a period of (90) days from receipt of sales order listed purchase date.

Covers internally lubricated components. Exclusion of coverage includes, but not limited to: Incorrect fluids, oil leaks due to faulty gaskets/seals, electrical components, or faulty installation by a third party or stated purchaser. Thomas Parts does not offer reimbursement for labor on transmissions and differentials. 

Labor Coverage

Thomas Parts offers up to $750 labor reimbursement on used engines. Warranty exclusions include, but not limited to; Towing, Loss of Revenue, Accident/Abuse/Neglect, Diagnostic Time, Shop Supplies, Fluids, Leaks of any kind, Travel/Lodging

Warranty Coverage Discretion

Repair, and replacement will be at the sole discretion of Thomas Parts Inc. Any claims can not and will not exceed the original purchase price of the original part(s) purchased. Thomas Parts’ provided as replacements under this warranty are warranted only for the remainder of the original stated sales order purchase date.

Shipping cost are no reimbursed under warranty claims. There are no other expressed, implied, written or oral warranties set forth herein. Any modifications of the stated warranty shall be in writing by an authorized Thomas Parts Inc representative prior to purchase.

All purchased part(s) including: engines, transmissions, differentials, electronic(s) or otherwise must be maintained at factory specifications in regards to horsepower, torque, etc.

Faulty installation is not covered under this warranty

Indemnity

SELLER SHALL INDEMNIFY, DEFEND AND HOLD HARMLESS PURCHASER, ITS EMPLOYEES, AGENTS, SUBCONTRACTORS AND CUSTOMERS FROM AND AGAINST ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES AND EXPENSES (INCLUDING ATTORNEY’S FEES) FOR ANY INJURY INCLUDING, WITHOUT LIMITATION, BODILY INJURY, DEATH OR PROPERTY DAMAGE ARISING DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM THE USE OF THE MATERIAL OR THE SELLER’S BREACH OF THE ORDER BY THE SELLER, INCLUDING, WITHOUT LIMITATION, ANY SUCH CLAIMS, LIABILITIES, DAMAGES, LOSSES AND EXPENSES CAUSED OR OCCASIONED BY ANY NEGLIGENT ACT OR OMISSION OF PURCHASER, ITS OFFICERS, AGENTS, EMPLOYEES, INVITEES OR LICENSEES.

Warranty Claim Procedure

1. Purchaser shall provide via E-Mail the name, address, phone number, and contact of the repair facility along with the following:

Detailed Diagnosis Report

Estimate Repair that includes Part Numbers + Scope of Labor

2. Repair facility must be one that is open to the public and is in the business of diesel engine repairs to include Transportation, Industrial, or Energy industries.

3. Repair facility must be willing and able to use Thomas Parts’ provided or supplied parts

4. All warranty reimbursements will be made to the purchaser after repair invoices are submitted

Any and all Warranty work Must be Authorized by Thomas Parts Inc. PRIOR TO repair; including labor, parts removal or otherwise. Failure to do so will result in claim denial.
